MINEOLA, N.Y. -- An unemployed man suspected of faking his own drowning at a New York beach to collect on life insurance has been re-arrested.

Nassau County prosecutors say Raymond Roth contacted his estranged wife by telephone on Wednesday night. She has an order of protection.

The Massapequa man (mas-uh-Pee-kwa) was arrested earlier Wednesday on charges including conspiracy to commit insurance fraud. He pleaded not guilty and was released on $100,000 bail.

His attorney says he will plead not guilty to the latest charge.

His 22-year-old son, Jonathan, was arrested last week and is free on bond.

Attorney Brian Davis says the elder Roth has been receiving psychiatric treatment.

After he vanished, authorities conducted an extensive search for several days before Roth was reported to be at a Florida resort.
