Once a business owner has decided on a name, Albertazzi shares the following two tips on what they need to do next:
No. 1: Register the business name with the Secretary of State. "Most people are familiar with the Secretary of State in their jurisdiction. This office keeps track of business names used by people, connecting real people with business names," said Albertazzi. "This service is provided for the benefit of the general public, making it easy for someone to go to the Secretary of State's website to answer a basic question: Who is behind this business? After all, whatever the name used, businesses are ultimately the people behind them. As a business owner, you can also find out if someone else has already thought of your business name and is using it."
No. 2: Protect your legal rights to the business name. "Perhaps you think that by filing the business name with the Secretary of State you 'own' the business, or at least the name of the business. This is a common misconception," stressed Albertazzi. "What you have done is fulfill your duty as a business operator, but not done anything to protect your legal rights to the business name.
